Spain's top prosecutor, the country's chief legal officer, has been forced to step down after being found guilty of disclosing confidential information in a highly contentious case that has intensified political divisions within the country.
Court Ruling and Penalties
The Supreme Court found that the attorney general had unlawfully revealed information about the tax situation of entrepreneur Alberto González Amador, who is the partner of a senior conservative politician.
The court handed down a two-year ban from his position and a penalty of €7,200. Furthermore, he must compensate ten thousand euros to Mr González Amador as compensation.
Political Fallout
The legal proceedings of the attorney general fueled the previously strained relations between the left-wing government of the nation's leader and the right-wing opposition.
Contrasting positions were highlighted by reactions to the guilty verdict.
"Sánchez must offer an apology to Spaniards, resign and call elections, in that order," said a spokesperson for the conservative People's Party.
The administration stated it did not agree with the ruling but respected it and would proceed with the appointment of a new attorney general.
Judicial Dispute
However, numerous politicians on the left expressed anger at what they viewed as a decision influenced by politics.
A cabinet member, of the progressive coalition, stated the conviction dealt a "lethal blow to the principle of innocent until proven guilty" and compromised citizens' rights when it came to the rule of law.
Origins of the Matter
The complicated legal matter dates back to March 2024, when the prosecutor's department issued a press release indicating that Mr González Amador had requested a plea bargain after being found to have evaded tax payments worth over 350,000 euros.
The document corrected mistaken press reports stating that the attorney general's office had initiated the settlement.
The origin of the incorrect reports was the head of communications of the conservative regional president of the capital region.
Court Case Details
The businessman filed a complaint against the chief prosecutor, alleging his confidentiality was violated. The case against García Ortiz also saw him accused of leaking information about the affair to the press.
Legal authorities highlighted the prosecutor's decision to replace his mobile device as incriminating.
However, there was no conclusive proof connecting García Ortiz to the leak and several journalists stated under oath during the proceedings that he had not been the source of their reporting.
Regarding the press statement, the prosecutor stated he was merely rectifying the inaccurate information.
The attorney general can appeal against the ruling.
Wider Political Implications
This comes as a severe blow for the national leader, who has been under judicial pressure on multiple issues.
- A family member is scheduled for court proceedings for alleged corruption
- The prime minister's spouse is being examined for her commercial dealings
- Former party officials in the governing political organization are accused of overseeing a large-scale corruption operation
